Overview
Rochester is located in New York. Drone operations are governed by federal FAA regulations (14 CFR Part 107) and may be subject to state and local ordinances.
State Regulations & Statutes
New York State regulates drone operations primarily through penal statutes and parks policies rather than a comprehensive UAS act. NY Penal Law § 240.26 (harassment) and related statutes apply to drone-based harassment or surveillance. New York State Parks prohibit drone operations in all state parks without a permit, administered by the New York State Office of Parks, Recreation and Historic Preservation (OPRHP). New York City has its own strict drone ban, but Rochester is subject to state rather than city-level restrictions. The Rochester area airspace is dominated by Greater Rochester International Airport (KROC) Class C airspace that covers much of the urban area, and Lake Ontario's shoreline creates unique coastal flying conditions.
Applicable Statutes & Penal Codes
- NY Penal Law § 240.26: Harassment statutes apply to drone-based following or surveillance of individuals
- New York State Parks OPRHP: Drone operations prohibited in all NY State Parks without advance permit
- KROC Class C airspace: LAANC authorization required within 5 nm of Greater Rochester International Airport
- FAA Part 107 Remote Pilot Certificate required for all commercial drone operations
- FAA drone registration required for all UAS over 0.55 lbs
- Monroe County parks: Contact Monroe County Parks for drone operation authorization
- City of Rochester parks: Contact Rochester Parks and Recreation for advance written permits
- Lake Ontario shoreline (NYS-managed): State park permit required for operations on or near state-managed shoreline
Permits & Registration
Commercial operations require FAA Part 107 Remote Pilot Certificate. LAANC authorization required for KROC Class C airspace — use FAA DroneZone or Aloft. New York State Parks require written permit from OPRHP (parks.ny.gov) for drone operations — apply at least 2 weeks in advance. City of Rochester parks require advance written authorization from Rochester Parks and Recreation. Monroe County parks require county parks department authorization.

Local Ordinances
Rochester administers drone restrictions through the city's parks regulations and the Monroe County park system. Greater Rochester International Airport Class C airspace covers most of the city, making LAANC authorization necessary for nearly all urban flying. The Genesee River Gorge, located in Letchworth State Park (one of the most scenic state parks in the eastern US, 35 miles south), is entirely off-limits to drones under NYS Parks regulations. The Lake Ontario waterfront parks and Charlotte Beach area are popular destinations that require advance permits.
Local Restrictions & Rules

Local Flying Guide
Always verify conditions with local authorities and property owners before flight.
Potential Safe Flying Locations
- Rural Wayne County east of Rochester — outside Class C; Finger Lakes agricultural region with landowner permission
- Ontario County farmland southeast — Finger Lakes wine country; open terrain; verify LAANC for KROC proximity
- Livingston County rural areas southwest — outside Class C boundary; gently rolling farmland
- Monroe County rural northwest (Greece/Hilton area beyond Class C) — open Lake Ontario Plain farmland
- Private rural land near Brockport (Monroe County) — outside Class C; flat agricultural land on the ridge
- Letchworth State Park gorge overlooks (with NYS Parks permit) — spectacular Genesee River Gorge scenery
Areas to Avoid
- KROC Class C airspace — covers most of Rochester from surface to 4,000 ft; LAANC required
- All City of Rochester parks — written permit required
- All Monroe County parks — written authorization required
- New York State Parks throughout the region — NYS OPRHP permit required before flying
- University of Rochester Medical Center complex — major medical facility; privacy restrictions
- Letchworth State Park — permit required; popular destination but strictly enforced
- Genesee River High Falls/gorge area — state-managed; permit required
- Charlotte Beach / Ontario Beach Park — city park; permit required; potential TFRs during special events
Weather Considerations
Rochester has a humid continental climate with one of the cloudiest and snowiest weather patterns in the continental United States. The city is located in the Lake Ontario snowbelt — lake effect snow events November through February can drop 2–3 feet in 24–48 hours. Rochester averages approximately 99 inches of snow annually. Winters are long and dark — the city averages only 60 sunny days per year. Spring is short but can be beautiful. Summers are warm and relatively pleasant with occasional afternoon thunderstorms. Check NWS Buffalo (weather.gov/buf) for Lake Ontario lake effect advisories.
Seasonal Tips
BEST: May–June (Lilac Festival timing, spring blooms, first extended clear weather) and late September–October (fall foliage on the Genesee River and Finger Lakes region is spectacular). AVOID: November–March (lake effect snow shutdowns, extreme cold, battery performance severely degraded — temperatures below 0°F occur regularly). Lilac Festival at Highland Park in May is a major event — the park is closed to drone operations during festival weeks. The Finger Lakes wine country south and east of Rochester offers excellent autumn aerial photography opportunities on private vineyard property with permission.
